These Terms of Service ("Terms") govern your access to and use of the TopFoxx Virtual Try-On application at topfoxx.app ("Service"), operated by TopFoxx ("TopFoxx," "we," "us"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Acceptance of Terms
By using topfoxx.app, browsing frames, uploading a photo, generating a try-on image, or completing a purchase, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy, which is incorporated by reference.
2. Eligibility
You must be at least 13 years of age to use the Service. If you are under the age of majority in your jurisdiction, you may only use the Service under the supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf.
3. Description of Service
TopFoxx provides a free, browser-based virtual try-on experience that uses artificial intelligence to render eyewear frames onto a photo you provide. The Service also includes an AI stylist chat feature, a personalization quiz, product browsing, and the ability to complete purchases through our checkout, which is powered by Shopify.
4. Acceptable Use
You agree not to:
- Upload a photo of any person without that person's knowledge and consent
- Upload content that is unlawful, obscene, defamatory, or infringes on the rights of others
- Attempt to reverse engineer, scrape, or extract the underlying models, source code, or product data of the Service
- Use automated means (bots, scripts) to access the Service in a manner that sends more requests than a human could reasonably produce
- Interfere with or disrupt the integrity or performance of the Service
- Use the Service for any unlawful purpose or in violation of any applicable local, state, national, or international law
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
5. Your Photos & Content
You retain all ownership rights to any photo you upload. By uploading a photo, you grant TopFoxx and its AI processing provider a limited, temporary, revocable license to process that image solely for the purpose of generating your virtual try-on result. As described in our Privacy Policy, your uploaded photo is not stored on our servers beyond the time required to generate your try-on image, is not used to train AI models, and is not shared for any purpose other than fulfilling your request.
You represent that you have all necessary rights and consents to upload any photo you submit, including consent from any other person depicted in that photo.
6. AI-Generated Images
Try-on results are AI-generated approximations, not guarantees of fit or appearance. While we aim for photorealistic accuracy, rendered images may not perfectly reflect how a physical product will look, fit, or fall on your face due to the limitations of AI image generation, lighting conditions in your original photo, and variations between digital renderings and physical products.
Generated try-on images are provided for illustrative and shopping-assistance purposes only. TopFoxx makes no warranty that a purchased product will match the virtual rendering exactly. You are encouraged to review actual product photography, measurements, and return policies before finalizing a purchase.
7. Third-Party Services
The Service integrates with and relies on third-party providers, including:
- Shopify, which processes product listings, shopping bags, checkout, payments, and order fulfillment. Your purchase transaction is subject to Shopify's own terms and the merchant policies of TopFoxx's storefront at topfoxx.com.
- AI processing providers, which generate try-on images and power the AI stylist chat via a secure server-side proxy.
TopFoxx is not responsible for the acts, omissions, or service interruptions of these third-party providers, though we select and monitor them with reasonable care.
8. Products, Pricing & Payment
All product prices are displayed in the Service and are subject to change without notice. Applicable discounts, including any earned through the Style Quiz, are applied at checkout and are subject to the terms of that specific promotion. Payment is processed securely through Shopify at the time of purchase. We do not store your payment card details.
9. Shipping, Returns & Refunds
Shipping timelines, return windows, and refund eligibility are governed by the shipping and returns policy published on our storefront at topfoxx.com. Please review that policy before completing your purchase. Promotional free shipping offers (such as those unlocked by sharing your try-on) are subject to the specific conditions disclosed at the time of the offer.
10. Intellectual Property
The Service, including its design, code, text, graphics, logos, and the TopFoxx name and marks, is the property of TopFoxx and its licensors and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use. You may not copy, modify, distribute, sell, lease, or create derivative works based on the Service without our prior written consent.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TOPFOXX DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT AI-GENERATED TRY-ON RESULTS WILL BE ACCURATE OR MATCH THE ACTUAL PRODUCT.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOPFOXX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100) OR THE TOTAL AMOUNT YOU PAID TO TOPFOXX IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
13. Indemnification
You agree to indemnify, defend, and hold harmless TopFoxx, its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any rights of a third party, including any person depicted in a photo you upload.
14. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our discretion. Provisions of these Terms that by their nature should survive termination will survive, including intellectual property provisions, disclaimers, indemnification, and limitations of liability.
15. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith informal negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the state and federal courts located in Delaware, except where applicable consumer protection law provides otherwise.
16. Changes to These Terms
We may revise these Terms from time to time. Material changes will be reflected by updating the "Last Updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. We encourage you to review this page periodically.
